Terms of Use

These Terms of Use ("Terms") apply to PrivateFloodRates.com and any related pages, forms, and communications (together, the "Site"). The Site is operated by Billy Kane ("we," "us," or "our"). By visiting the Site or submitting information through it, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.

Please note: Section 13 requires most disputes to be resolved through individual arbitration instead of in court, and it waives your right to join a class action. You can opt out of arbitration within 30 days by following the steps in Section 13.

1. Who can use the Site

You must be at least 18 years old and legally able to enter into a contract to use the Site or request a quote. The Site is intended for people seeking flood insurance for property located in the United States.

2. What we do

PrivateFloodRates.com is a free service that connects people looking for flood insurance with licensed insurance agents, agencies, brokers, and carriers ("Partners"). We are not an insurance company, and we do not issue policies, set rates, or make coverage or underwriting decisions.

When you submit a request, we share the information you provide with one or more Partners so they can contact you about your request. Partners are independent businesses, and their products and services are governed by their own terms.

3. No guarantee of quotes or coverage

Submitting a request does not guarantee that you will receive a quote, that coverage will be available for your property, or that any rate will be the lowest available. Any quote, premium, deductible, or coverage terms come from the Partner or carrier, and the actual policy language controls. Content on the Site is general information, not insurance, legal, or financial advice.

4. How we are paid

Using the Site is free. We are paid by Partners, including for referrals or for the contact information of people who request quotes. This compensation may influence which Partners receive your request. We are not a party to any agreement you make with a Partner and are not responsible for any fees or charges they apply.

5. Your information and consent to be contacted

You confirm that the information you submit is accurate and that it is your own, including that you are the subscriber or regular user of any phone number you provide.

By submitting a request, you give your express written consent for us and for the Partners identified on the form (or at the linked partner list) to contact you about flood insurance at the phone number and email you provided, including by calls and text messages that may use automated technology or prerecorded or artificial voices, even if your number is on a federal, state, or company Do Not Call list. Your consent is not a condition of any purchase. Message and data rates may apply, and message frequency varies.

You can withdraw consent at any time by replying STOP to a text, asking a caller to stop calling, or emailing quotes@privatefloodrates.com. Opting out with us does not automatically opt you out with Partners who already received your request; you may need to contact them directly.

6. Acceptable use

You agree to use the Site only for lawful purposes. You may not:

• Submit false information or information about another person without their permission.
• Use bots, scrapers, or other automated means to access the Site or submit forms.
• Interfere with the Site's security or operation, or introduce malicious code.
• Copy, resell, or commercially use Site content without our written permission.

7. Intellectual property

The Site, including its text, design, graphics, and logos, belongs to us or our licensors and is protected by copyright and trademark law. You may view and print pages for your personal use in requesting insurance. All other rights are reserved. "PrivateFloodRates" and related marks are our trademarks, and other marks on the Site belong to their owners.

8. Third-party sites

The Site may link to websites run by Partners or others. We don't control those sites and aren't responsible for their content, products, or privacy practices. Your use of them is governed by their own terms.

9. Disclaimer of warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR MAKE ANY WARRANTY ABOUT THE PRODUCTS OR SERVICES OF ANY PARTNER.

10. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, WE AND OUR OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR YOUR DEALINGS WITH ANY PARTNER, INCLUDING ANY UNINSURED OR UNDERINSURED FLOOD LOSS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to defend and hold us harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Site, or information you submit, including any phone number or email address that does not belong to you.

12. Changes and termination

We may update these Terms by posting a new version with a new effective date. Continued use of the Site after that means you accept the changes. We may suspend or discontinue the Site, or your access to it, at any time. Sections 7 through 14 survive any termination.

13. Dispute resolution and arbitration

Talk to us first. Before starting any claim, you agree to send a written description of the dispute to 2105 NW 36th Dr, Gainesville, FL 32605 or quotes@privatefloodrates.com and give us 60 days to try to resolve it informally.

Arbitration. Any dispute that isn't resolved informally will be decided by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and governed by the Federal Arbitration Act. The arbitrator may award the same individual relief a court could. Hearings may take place by phone, video, or in the county where you live.

Exceptions. Either party may bring an individual claim in small claims court, and either party may go to court over intellectual property infringement.

Class action waiver. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective, or representative proceeding. If this waiver is found unenforceable, this entire Section 13 will not apply.

Opting out. You may opt out of this arbitration agreement by mailing or emailing a signed notice to the address above within 30 days after you first use the Site. Opting out doesn't affect any other part of these Terms.

14. Governing law

These Terms are governed by the laws of the State of Florida and applicable federal law. For any matter not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in Alachua County, Florida.

15. Copyright complaints

If you believe material on the Site infringes your copyright, send a notice to our designated agent at Billy Kane, 2105 NW 36th Dr, Gainesville, FL 32605, quotes@privatefloodrates.com that includes: identification of the copyrighted work; the location of the material on the Site; your contact information; a statement that you believe in good faith the use is unauthorized; a statement, under penalty of perjury, that your notice is accurate and you are authorized to act for the owner; and your physical or electronic signature.

16. General

These Terms and our Privacy Policy are the entire agreement between you and us about the Site. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. We may assign these Terms; you may not assign them without our consent.
